Students will study the constitutional framework of regulation including the following issues: What role does the Constitution assign to the Congress, President and judiciary in the regulatory process? How can agencies be considered legitimate when they are not recognized in the Constitution? Does the Constitution create a "unitary executive" and what are the implications of this conception of the presidency? What are the implications of recent empirical studies demonstrating that the outcome of judicial review depends on whether a judge has been appointed by a president who was a Republican or Democratic? Students will also study the evolution of the administrative process including the following issues: What has been and should the impact of politics in the regulatory process? What has been and should be the impact of science in the regulatory process? How will the election of a new president in the U.S. impact the regulatory process?
